This Privacy Policy explains what information Jam Band Graveyard collects through the site, how we use and share it, how long we keep it, and what choices you have.

Jam Band Graveyard (“JBG,” “we,” “us,” or “our”) respects your privacy and is committed to handling your information with care, dignity, and restraint. This Privacy Policy explains what information we collect through the Jam Band Graveyard website (the “Site”), how we use it, when we share it, how long we keep it, and what choices you may have.

This Privacy Policy applies to information collected through the Site and through communications you send to us in connection with the Site, including tribute submissions, follow-up communications, newsletter signups, and privacy-related or legal requests.

Because JBG is a memorial and educational site, some of the information you share with us may relate to sensitive life events, grief, loss, or the memory of a deceased person. We approach that information with care. At the same time, if content is submitted for publication and published, some information may become public and may not be fully retractable after publication.

1. Scope of This Privacy Policy

This Privacy Policy applies to information collected through:

  • the Site;
  • forms made available through the Site;
  • email communications you send to JBG in connection with tribute submissions, corrections, removals, privacy concerns, legal concerns, or general questions; and
  • newsletter signup forms or other opt-in communication tools used by JBG.

This Privacy Policy does not apply to information collected by third-party websites, platforms, or services that JBG does not control, even if those third parties are linked from the Site or interact with the Site in some way.

2. What We Collect

Information you provide directly

We may collect information you choose to provide to us, including:

  • your email address;
  • the contents of tribute submissions, stories, photos, captions, and related materials you send to us;
  • information you include when contacting us by email or through forms on the Site;
  • information you provide when signing up for our email list; and
  • any other information you voluntarily choose to share with us.

Submission-related records we may create or retain internally

If you submit content for review or publication, we may also create or retain internal records related to that submission, including:

  • submission history;
  • correspondence with you about the submission;
  • requests for revisions, additions, corrections, or removals;
  • anonymity requests;
  • permissions or consent-related communications;
  • moderation notes;
  • dispute-related communications; and
  • records reasonably necessary for legal compliance, safety, or administrative purposes.

Limited technical, security, and analytics information

When you use the Site, we may receive limited technical information needed to operate, secure, protect, and understand how the Site is used. This may include:

  • IP address;
  • browser type;
  • device or system information;
  • access time;
  • limited technical interaction data associated with security protections; and
  • usage and navigation data collected through analytics tools, including pages visited, session duration, scroll behavior, and traffic source.

We do not use this information for behavioral profiling or advertising.

Google Analytics

We use Google Analytics, a web analytics service provided by Google LLC, to collect information about how visitors use the Site. Google Analytics uses cookies to collect data such as pages visited, time spent on pages, geographic region (city or state level), device type, and how visitors arrived at the Site. This information helps us understand how the Site is being used and how to improve it.

Google Analytics does not collect names, email addresses, or the content of any form submissions. We have configured Google Analytics with the following privacy settings: advertising signals are disabled, Google Signals is off, remarketing is off, and data retention is set to the shortest available period. No visitor to JBG will be targeted with advertising as a result of their visit to this Site.

First-Party Cookies

JBG does not use first-party advertising or marketing cookies through the Site. The cookies described in this section are used for analytics purposes only and are not used for advertising or to track visitors across other websites for commercial purposes.

4. What We Do Not Currently Offer Through the Site

For clarity, JBG does not currently operate the Site as a user-account platform, public message board, or ecommerce storefront.

The Site does not currently provide:

  • user accounts for public posting or login-based profile management;
  • open public message-board functionality;
  • on-site purchases requiring payment card processing; or
  • first-party advertising or marketing cookie systems operated by JBG.

If that changes in the future, we will update this Privacy Policy accordingly.

5. How We Use Information

We may use the information we collect to:

  • review, process, and respond to tribute submissions and related communications;
  • communicate with you about a submission, update, correction, removal request, or privacy concern;
  • publish submitted content if accepted, including with attribution or anonymously if requested and approved;
  • maintain records related to submissions, permissions, moderation decisions, disputes, and legal compliance;
  • operate, maintain, secure, troubleshoot, and improve the Site;
  • understand how the Site is used and identify ways to better serve the community;
  • investigate or respond to reports about privacy, consent, intellectual property, harmful content, or other concerns;
  • send newsletters or other updates to people who have chosen to receive them;
  • protect the rights, safety, dignity, and integrity of JBG, contributors, visitors, and others; and
  • comply with legal obligations and respond to lawful requests or process.

We do not use your contact information to send marketing or newsletter emails unless you have signed up to receive them.

6. Publication, Public Visibility, and Anonymity

If you submit content for publication and JBG accepts and publishes it, that content may become visible to the public.

Publicly available content may be:

  • viewed by visitors to the Site;
  • indexed by search engines;
  • shared by others through links, screenshots, reposts, or social media;
  • included in JBG newsletters or official social channels; and
  • retained in archives, cached pages, backups, or previously distributed materials.

If you request anonymity and JBG agrees to publish your submission anonymously, we will omit your name from the public-facing version of the content. However, public anonymity does not mean anonymity to JBG. We may retain your identity and contact information internally for review, follow-up, recordkeeping, safety, moderation, and legal purposes.

Because of the nature of online publication, content that has been published may not be fully retractable even if later removed from the Site.

7. When We Share Information

We do not sell or rent your personal information.

We may share information in the following circumstances:

With service providers

We may share information with third-party service providers that help us operate or support the Site, including providers involved in:

  • website hosting;
  • email communications;
  • technical support;
  • security and abuse prevention;
  • analytics; and
  • form handling or similar operational functions.

These providers may process information on our behalf to support JBG’s operations.

With the public

If you submit content that JBG accepts and publishes, the content you submit may be made public on the Site or through JBG newsletters, official social media channels, or similar nonprofit outreach communications, subject to any anonymity arrangement JBG has agreed to honor.

For legal, safety, and integrity reasons

We may disclose information if we believe doing so is reasonably necessary to:

  • protect the rights, property, safety, dignity, or integrity of JBG, contributors, Site visitors, or others;

In connection with organizational changes

We may transfer information as part of a merger, restructuring, transfer of assets, or similar organizational change if information must be transferred as part of that process.

We may also share information if you ask us to do so or otherwise consent.

8. Email Communications

If you sign up to receive JBG newsletters or other email updates, we may send you those communications.

You may opt out of marketing or newsletter emails at any time by using the unsubscribe link in the message or by contacting us at help@jambandgraveyard.org.

Even if you opt out of marketing emails, we may still contact you about:

  • a tribute submission;
  • a privacy request;
  • a correction or removal issue;
  • a legal, safety, or consent-related concern; or
  • other administrative matters related to the Site.

9. Data Retention

The short version: we keep records for as long as we need them to run this site responsibly. Some records stay in our system even after content is removed from public view. A deletion request does not guarantee that every associated record is erased.

We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

  • review and manage submissions;
  • communicate with contributors and requestors;
  • maintain archives, backups, and administrative records;
  • document permissions, disputes, moderation decisions, and removal history;
  • comply with legal obligations; and
  • protect the Site and community.

Because of the nature of memorial submissions and publication workflows, some records may be retained even after content is removed from public view. For example, JBG may retain internal records relating to:

  • consent or permission history;
  • authorship or ownership questions;
  • privacy-related concerns;
  • moderation decisions;
  • dispute correspondence; and
  • legal compliance or risk management.

We do not promise that every deletion or removal request will result in complete erasure of all associated records.

10. Your Choices and Requests

You may contact us to request that we:

  • update or correct information you have provided to us;
  • remove you from our newsletter list;
  • review a request to delete or remove certain personal information we hold about you;
  • review a privacy concern related to content on the Site; or
  • review a concern about public anonymity, identifying information, or sensitive information appearing in published content.

We will review requests in light of applicable law, the nature of the request, our legal obligations, the public or archival status of the content, and the need to retain certain records for administrative, safety, archival, or legal reasons.

A request to remove published content, or information associated with published content, may also be handled under JBG’s Terms of Service and related reporting processes.

JBG does not knowingly collect personal information through the Site from children under 13.

If you are a parent or guardian and believe a child under 13 has provided us with personal information, please contact us at legal@jambandgraveyard.org so we can review the situation and take appropriate action.

If JBG becomes aware that personal information from a child under 13 has been collected through the Site without appropriate authorization, we will review the situation and take action we believe is appropriate under the circumstances.

12. Security

We use reasonable administrative, technical, and organizational measures designed to protect information we hold from unauthorized access, use, alteration, or disclosure.

However, no website, form, online system, email transmission, or storage method is completely secure. For that reason, we cannot guarantee absolute security.

13. Third-Party Links and External Services

The Site may contain links to third-party websites, resources, or services. JBG is not responsible for the privacy practices, content, security, or policies of third-party sites or services.

When you leave our Site or interact with a third-party tool or platform, your information may be governed by that third party’s own terms and privacy practices rather than this Privacy Policy.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page and revise the Effective Date above.

Your continued use of the Site after changes become effective means the updated Privacy Policy will apply to your use of the Site going forward.
